By accessing lcare.us (the "Site") or engaging services from LLL Care LLC ("we," "us"), you agree to these legally binding Terms of Service ("ToS"). If you disagree, discontinue use immediately.

2. Services Overview

Scope: Non-medical in-home care (companion/personal care, specialized support, transportation).
Exclusions: We do not provide medical services (e.g., injections, wound care, skilled nursing).
Eligibility: Clients must reside in our Central Florida service area and complete a free care assessment.

3. Client Responsibilities

You agree to:

Disclose health conditions, allergies, and behavioral risks (e.g., dementia aggression).
Maintain a safe home environment (e.g., clear walkways, functional smoke detectors).
Provide 24-hour notice for cancellations/rescheduling to avoid fees.Notify us immediately of changes in care needs or emergency contacts.

2. Services Overview

  • Scope: Non-medical in-home care (companion/personal care, specialized support, transportation).

  • Eligibility: Clients must reside in our Central Florida service area and complete a free care assessment.

3. Client Responsibilities

You agree to:

4. Payments & Billing

  • Fees: Hourly/live-in rates quoted after assessment. Rates subject to change with 30-day notice.
  • Invoices: Billed weekly via email. Payment due within 15 days.
  • Late Payments: 1.5% monthly interest on balances overdue >30 days.
  • Insurance: We assist with long-term care insurance claims but do not guarantee reimbursement.

5. Cancellation Policy

  • Cancellations: No fee if notified >24 hours in advance.
  • Late Cancellations: 50% service charge for <24-hour notice.
  • Emergencies: Fees waived for hospitalizations or family crises (with documentation).

6. Caregiver Assignments

  • We reserve the right to change caregivers due to scheduling, safety, or client requests.
  • Clients may decline a caregiver once per assignment without penalty.

7. Limitations of Liability

  • Not Liable For:
    • Injuries from unreported home hazards or undisclosed client behaviors.
    • Loss/theft of client property not documented in our care plan.
    • Third-party acts (e.g., medical malpractice by external providers).
  • Maximum Liability: Limited to fees paid for services in the 30 days preceding a claim.

8. Intellectual Property

  • All Site content (logos, text, images) is owned by LLL Care LLC. Unauthorized use is prohibited.

9. Privacy & Confidentiality

  • Client data is handled per our Privacy Policy.
  • Caregivers sign HIPAA-compliant confidentiality agreements.

10. Termination

We may terminate services if:

  • A client/representative threatens caregiver safety.
  • Payments are overdue >60 days.
  • Client needs exceed our non-medical scope.

11. Dispute Resolution

  • Mediation: Florida-based mediation required before litigation.
  • Governing Law: Florida statutes (Orange County courts for disputes).

12. Changes to Terms

  • Updates posted at lcare.us/terms of service with a new effective date.
  • Continued use constitutes acceptance.

Florida Home Care Compliance Addendum

  1. Compliance: Not operated under Florida Agency for Health Care Administration (AHCA)
  2. Caregiver Standards: All staff pass Level 2 background checks, drug screenings, and 40-hour training.
  3. Client Rights: Per Florida Statute 400.488, clients retain rights to dignity, privacy, and complaint filing.
  4. Abuse Reporting: Mandated by law to report suspected abuse/neglect to Florida DCF.
